Steve Madden, Shoe Plagiarist? You Be the Judge
can you even tell which is which?
Alexander McQueen is suing Steve Madden, alleging that Madden copied one of their shoe designs.
The much more expensive McQueen shoe, called the Faithful bootie, was released in January, and the company is claiming that Steve Madden's Seryna bootie (right) is a "studied imitation" of it that seeks to cash in on the popularity of the McQueen shoe.
There are no "fashion copyrights," and several stores take runway couture pieces and create cheaper "replicas" for the masses (Forever 21, H&M). But is this wrong? Should there be intellectual property for fashion designers?

it's wrong of him to "plagiarize" the shoe, but if there's no copyright, it's free game.

I'm sure the Madden ones are made of less quality material anyway. I thought Madden usually copied high fashion shoes and made cheaper ones for us poorer folks?
Yes its wrong, but this sort of thing happens all of the time. I would be pissed if it happened to me.
Is there even a difference? I can't tell. But when there is no copyright for fashion, well too bad for you Mr McQueen. I am not into highheels anyway.

He should have made something different. That's just too close. After this, they probably will make copyrights for fashion. They probably won't be strict, but making an identical product will probably be illegal, as it should be.
there is barely a difference in spacing of the side flaps and the color is slightly different and the purposeful wearing (the "worn-in" look, i mean) is also slightly different.
those are SUPER small differences though. i'm not sure though if i think it's ok to sue people for having the same idea. i mean, we're pretty sue-crazy about everything else already and i don't think adding fashion to that list will do any good. i do think though that artists should come out to the public about the copying and just let the public do as they wish with the jocker. i think that's the best way to handle the situation, personally.
this makes me sad, though, because i love both of these designers. it's sad to see them steal ideas from ANYONE let alone another designer i love. :\

hrm, i thought designers copy each other all the time.
Wait, the shoe on the left is McQueen and the shoe on the right is Madden? They look exaclty the same! Even though there may not be a copyright, I think it's common sense that you don't steal the EXACT SAME design. There are tons of knock offs of name brands but they all differ slightly from the original. This is seriously ridiculous.

I guess it's wrong but if business's didn't make knock of fashions all the time (which they do) most of us wouldn't be able to hop on the band wagon of whatever is trendy at the time
Eh, technically it's wrong. BUT if they made things more affordable we'd buy them, thus not needing the "cheaper" shoe.
They should have the right to sue, it's their design and if the other company is selling cheap versions of the shoe, that makes the original company lose money.

It's wrong..but if there is no copyright, there isn't much you can do. they could always say they made it before you, just hadn't put it out yet. ha. people are crazy like that.
he could have at least tried to change it.

the shoes aren't even that cute.
I say, let it go. Sucks that didn't try and change it very much, his own fault. But, it happens quite often. I thought many style ideas were ripped off from designer lines...and slightly changed with more affordable prices. blah, don't care too much.
madden just makes the same beautiful looking shoes for an amount of money that a normal person can actually afford.
