Looks like the eldest Kardashian sisters may have to cough up 10 mil to makeup artist Lee Tillett, who says the girls jacked her cosmetics line name “Kroma”, just adding the “H”.
Apparently Tillet founded her cosmetics line, Kroma, in 2004 and refuses to be stripped of the spot light. The Kardashian girls claim they took all the necessary legal measurements to secure their beauty brand’s name.
Is this purely a brand name similiarity coincidence or does Lee Tillet deserve her 10 million?

as much as i hate the kardashians as people, they have some nice makeup. i just bought one of their palettes and it’s awesome. i think the name is just coincidence.

Anyways I’ve seen some review of the products and apparently their really bad (the kardashian’s that is) so perhaps they aren’t going to be much of a competition anyways? But the original Kroma deserves the money, it’s evidently on purpose because I’ve heard this story so long ago before.

@Cho_0705@xanga - No, they haven’t. You probably read that article on Yahoo, which is where it was featured. Lovelyish tends to get A LOT of their info from that website. At least from what I can tell.

Anyways, I’ve never even heard of the other brand, so I don’t think that they should receive 10 million dollars. That’s crazy.

The question prompt that lovelyish wrote for this post is a bit ridiculous. 1) I doubt anyone on this site knows much about trademark law, and 2) the question itself most likely is drawing a false dichotomy that doesn’t track applicable trademark law.
As for my answer to the question asked: I have no clue because I just know enough to know that I have no idea about what current trademark law is and what the underlying theories are for such laws.
