Unfortunately, I’m never really shocked when celebrities file ridiculous law suits. From the outside looking in, it seems they’re all a little too sensitive about things. This is how I felt about Kim Kardashian’s recent law suit against Old Navy for using a model who looks just like her. My first reaction: really, Kim? REALLY?
I guess I can kind of understand that she was peeved they made it seem like Kim was the actual spokeswoman. However, come to find out, it’s much more than just being angry over a Kardashian wannabe.
The Kardashian trio have signed a contract with Sears worth millions to promote a new ad campaign for the Kardashian Kollection launching in about a month or so. As soon as Sears saw the Old Navy commercial, they got their panties in a twist, actually questioning Kim on whether or not she was seeing Old Navy on the side.
God forbid “confusion in the marketplace” is created. Now after hearing this side to the story, I can’t really blame Kim. I’d be worried about protecting my assets (pun intended) as well, especially when they’re worth millions.
Point being, this whole debacle is very much about adding more millions onto the ever-growing heap of the Kardashian gold mine, as opposed to Kim being upset over a random look-a-like. [via TMZ]

It makes a little more sense now, I guess. But at the same time, you can’t really sue someone for looking like you. It’s not like they’re calling her Kim Kardashian. They just have a model who happens to look like her, and unless the model had plastic surgery or something so that she could look like Kim, she was BORN that way and you can’t really sue her (or the company she works for) for that.

I knew there were more details about it than just her suing on her own. Again, that’s what I said before hand. A look a like could cause problems especially on the business side. It’s kind of a shame, I’m almost the only one that picked that up while everyone cursed and spat at Kim.
Funny how that is.

I agree with the first poster. You can’t sue someone for using a model that looks like you. I can understand that it caused a misunderstanding, but if you got it straightened out, what is the point of suing?

When I saw that Old Navy commercial I didn’t even think for a second about Kim Kardashian. I thought “oh just another typical mediocre pop singing girl”. So I guess I just can’t see how it’s blatantly copying her “persona” or whatever…

Kim has no grounds to sue the commercial, she is a public figure due to her sex tapes (that she definately leaked), random appearances, and show promotions. She is an attention whore and definately has a lot of it. I hope Old Navy has an awesome reply to the lawsuit like Hallmark Cards did to Paris Hilton when they imitated her catchphrase on a card.

I think there’s more to the story than just this. The girl who looks like Kim supposedly ended up using her name as well in other commercials and promotions to get the few millions of dollars.
Is suing Old Navy is the right way to go? No. I do however, think that maybe to prevent future confusion, add in some fine fine print that the girl is indeed NOT Kim.
In all honesty, I think Kim’s only upset that this look a like has been profiting from her name.
Now stop bashing on the girl, because she’s done good things in her life too.

Well, yeah, of course it’s about money. I’m kind of surprised that anybody really thought otherwise. Admittedly, I assumed she was looking for damages or more PR, thus generating more interest, which seems to be her sole income earning potential.

@AuCinema@xanga - Actually Sears has beautiful clothes and a lot of the time, there is always sales going down which is always good for my bf and I since we’re always on a budget. And sometimes Sears has good deals in other things too.

Also people don’t realize that a lot of that money will be going to Kim’s legal team and not her. She won’t be getting that hefty sum all the way herself. I think a lot of people are so hateful and so biased against Kim, that they can’t see straight sometimes. It makes me sad when people bash someone they don’t personally know. I never understand how people get so filled with so emotion towards a celeb.

@Hinase@xanga - Hm, I guess it must be the Sears in my area then. It’s awful. I don’t know anyone who goes in there for anything other than garden supplies. And it’s not as though I come from a wealthy area or anything.

I think she’s right to sue them. Its obvious that they used the model because she looks like Kim, making customers think Kim is endorsing them, therefore they’re making money off of Kim’s imagine. That’s not okay. Obviously she doesn’t need the money, but its not about the money.

if the lawsuit is frivolous it won’t win in court. anybody has the right to sue whoever they want, it doesn’t mean the court will listen. honestly, does anyone really care?

It still seems dumb to me. The girl can’t help that she looks like Kim. Plus I agree with people who think she looks more like Nicole from the PCD. Kim’s beauty isn’t entirely unique. Why couldn’t Kim just get the people at Sears to call Old Navy and ask them? Or just have told them the truth? I doubt she’s the first celebrity who has been mistaken for a model in a commercial or the first time it has caused an issue. It’s been a while but I remember growing up mistaking many tv models for the actresses I saw. Plus I don’t get how starting a lawsuit that seems to have no legal basis and thus would just cost Kim money would protect her money.

She actually can sue. There is the right to publicity which gives individuals the right to control the commercial use of their name, image, likeness or other aspects of one’s identity.
(“Image” does not need to be a photo/video of the actual individual, it can be a cartoon, look-a-like etc)
Even though the model wasn’t actually Kim herself, Kim is associated with the image the store is portraying and they are using her “likeness” and “image” with out her written consent. She most certainly can sue the company for this.
The company intentionally hired a Kim look-a-like to be portrayed in Kim’s image.

They’re not claiming that she IS Kim and she’s not claiming to be Kim, so I still don’t see what the big deal is. Like another commenter said, she can sue, but that doesn’t mean the lawsuit isn’t stupid. Maybe I should go out and find a model who looks like me and sue the company using her for using my “likeness.” Maybe she should put out a statement saying that she doesn’t shop at Old Navy and wants to clear up confusion or something, but a lawsuit is a little excessive.

@bbanmen420@xanga - Having a sex tape isn’t “discusting” (I think you meant disgusting). You really shouldn’t judge others or what they do based on your own moral, religious, and perrsonal decisions. She is an of age, legal, adult who chose, willingly, to tape herself having consensual sex. Don’t like sex tapes? Don’t make one. Don’t like sex tapes? Don’t watch hers.
